Chief Justice Torkornoo Drags Government To ECOWAS Court Over Removal
Deputy Attorney General, Justice Srem-Sai, has confirmed that suspended Chief Justice Gertrude Araba Esaaba Torkornoo has filed a case at the ECOWAS Community Court of Justice in Abuja, Nigeria, challenging her suspension and the process initiated for her potential removal from office.

The application, filed on July 4, 2025, alleges human rights violations resulting from what she describes as an unjust suspension without a conclusive determination of the petitions against her.
“Her Ladyship argues that by her suspension, she has effectively been removed from her official role without final findings, thereby infringing on her constitutional right to serve,” Justice Srem-Sai stated in a Facebook post on July 8.
Justice Torkornoo is currently facing three separate petitions in Ghana seeking her removal. She has already filed legal challenges at both the Supreme Court and the High Court against her suspension by President John Dramani Mahama, which was carried out under Article 146 of the 1992 Constitution.
Meanwhile, the Attorney General’s office has filed a motion in the Human Rights Division of the High Court to strike out Torkornoo’s application for judicial review, describing it as procedurally flawed.
President Mahama has insisted that his administration is acting in full compliance with constitutional requirements, stating that the matter now rests with a five-member investigative committee.
The Chief Justice’s suspension has sparked widespread debate about judicial independence, with concerns raised by civil society, legal experts, and political leaders including the New Patriotic Party and the Minority in Parliament.
The findings of the investigative committee will ultimately determine whether Justice Torkornoo is reinstated or removed from office.
