The High Court has dismissed an application by Nana Akua Afriyie, the New Patriotic Party’s (NPP) 2024 parliamentary candidate for Ablekuma North, which sought to halt the scheduled rerun of parliamentary elections in 19 polling stations on July 11, 2025.

Justice Ali Baba Abature, who presided over the case, ruled that the application for an interim injunction was “unmeritorious,” emphasizing that the Electoral Commission’s (EC) constitutional mandate to ensure representation for the constituency takes precedence.

Afriyie’s legal team argued that the EC’s move violated a prior January 4, 2025, court ruling directing the collation of 62 outstanding results from the December 2024 polls and the declaration of a winner. They claimed that only three polling station results remained uncollated and that all were already verified by presiding officers and party agents. They further argued that under Regulation 42 of C.I. 127, a rerun is only warranted in the case of a tie something the EC has not alleged.

However, Justice Abature pointed out that the applicant failed to demonstrate that the remaining results could be legally collated without further verification. He reaffirmed the EC’s constitutional authority to conduct elections and stressed that any delay would deny residents of Ablekuma North their right to parliamentary representation.

“The application for injunction against the respondent is dismissed as unmeritorious,” the judge ruled, noting that the EC may be liable for compensation should Afriyie succeed in a future substantive case.
